These Terms of Service ("Terms") govern your access to and use of the Milestone service, available at milestone.qfhq.io ("Service"), operated by Milestone ("Company," "we," "us," or "our"). By accessing, registering for, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

By accessing and using Milestone, you represent and warrant that you are at least 18 years of age or the age of majority in your jurisdiction, and that you have the full right and authority to enter into and be bound by these Terms. If you are using the Service on behalf of an organization or entity, you represent that you are authorized to bind that organization or entity to these Terms.

Your use of the Service is conditioned on your acceptance of these Terms in their entirety. If you do not accept all provisions of these Terms, you are not permitted to use the Service. We reserve the right to modify these Terms at any time. Your continued use of the Service after such modifications constitutes your acceptance of the modified Terms.

2. Description of Service

Milestone is a web-based platform designed to provide users with tools and features for goal tracking, progress monitoring, and milestone management. The Service includes, but is not limited to: user dashboards, goal-setting utilities, progress tracking capabilities, data visualization tools, and related features ("Features").

The Service is provided on an as-is, as-available basis. We do not guarantee the availability, accuracy, or completeness of any content or functionality within the Service. Features and functionality may be modified, suspended, or discontinued at any time at our sole discretion.

Access to the Service may be limited to registered users who maintain an active subscription. The Service is intended for personal, non-commercial use unless otherwise authorized in writing by the Company.

3. User Accounts

3.1 Account Registration

To access the Service, you must create a user account by providing accurate, current, and complete information as requested by the registration form. You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree not to share your account access with third parties.

3.2 Account Responsibility

You are solely responsible for all activity that occurs under your account, whether authorized by you or not. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. The Company is not responsible for any loss or damage resulting from unauthorized access to your account due to your failure to maintain password confidentiality.

3.3 Account Termination

The Company reserves the right to suspend or terminate your account at any time, with or without cause, and without notice or liability. Grounds for termination include, but are not limited to: violation of these Terms, misuse of the Service, failure to pay subscription fees, or any conduct we deem inappropriate or harmful.

3.4 Account Data

You retain all rights to any data, content, or information you upload or create within your account. However, by using the Service, you grant the Company a non-exclusive, royalty-free, worldwide license to use, display, and analyze your account data solely for the purpose of providing and improving the Service.

4. Payment Terms

4.1 Subscription Pricing

The Service is offered on a subscription basis at nine dollars ($9.00) per month, billed monthly in advance. This price is subject to change upon thirty (30) days written notice. If the subscription price is increased, we will notify you via email, and you will have the opportunity to cancel before the new price takes effect.

4.2 Billing and Payment

By providing your payment information (credit card, debit card, or other payment method), you authorize the Company to automatically charge your selected payment method for your monthly subscription fee on the billing date each month. You are responsible for maintaining accurate and current payment information in your account. If payment fails, your access to the Service may be suspended or terminated at our discretion.

All payments are processed in United States dollars. If you reside outside the United States, you are responsible for any currency conversion fees or charges imposed by your financial institution or payment processor.

4.3 Cancellation Policy

You may cancel your subscription at any time by logging into your account and following the cancellation instructions, or by contacting our customer support team. Cancellations become effective at the end of your current billing period. You will continue to have access to the Service until the end of your paid billing cycle.

Cancellation requests must be submitted at least forty-eight (48) hours before your next scheduled billing date to prevent charges for the next billing period. The Company is not responsible for duplicate charges resulting from failure to properly cancel your subscription.

4.4 Refund Policy

The Service is provided on a subscription basis and is considered a digital service. Subscription fees are non-refundable, except as required by applicable law. Once payment is processed and your subscription is activated, no refunds will be issued for partial months, full months, or unused portions of your subscription.

In the event of a billing error or duplicate charge caused solely by the Company, we will credit your account with the disputed amount within thirty (30) days of verification. To report a billing error, you must contact our customer support team within sixty (60) days of the charge in question.

Nothing in this refund policy shall prevent you from exercising any statutory consumer rights you may have under applicable law. If you are located in a jurisdiction that requires a refund policy for digital services, you may be entitled to refunds in accordance with that jurisdiction's laws, and you should contact us for information about your specific rights.

4.5 Late Payment

If your payment is declined or fails to process, the Company reserves the right to retry the charge up to three times over a seven-day period. If payment ultimately fails, your subscription will be suspended, and you will lose access to the Service until payment is successfully processed. Repeated payment failures may result in permanent account termination.

5. Intellectual Property

5.1 Company Intellectual Property

The Service, including but not limited to its design, layout, functionality, text, graphics, images, logos, source code, and all other materials comprising the Service, are the exclusive property of the Company or its licensors and are protected by United States and international copyright, trademark, patent, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal use in accordance with these Terms. You may not reproduce, distribute, transmit, modify, create derivative works of, or otherwise exploit any portion of the Service without the Company's prior written consent.

5.2 User Content

You retain all intellectual property rights to content you create and upload to the Service, including goals, notes, and other personal data ("User Content"). However, by uploading User Content to the Service, you grant the Company a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content solely for the purpose of providing the Service and improving our features and functionality.

5.3 Feedback

Any feedback, suggestions, or ideas you provide regarding the Service or the Company ("Feedback") may be used by the Company without obligation or compensation to you. You hereby assign all intellectual property rights in such Feedback to the Company.

6. Limitation of Liability

6.1 Disclaimers

The Service is provided on an "as-is" and "as-available" basis without warranty of any kind, express or implied. The Company disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

The Company does not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected. The Company does not warrant that the Service will meet your requirements or that results obtained through the Service will be accurate or reliable.

6.2 Limitation of Damages

In no event shall the Company, its officers, directors, employees, agents, or licensors be liable to you for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, even if the Company has been advised of the possibility of such damages.

Your sole and exclusive remedy for dissatisfaction with the Service is to discontinue your use of the Service and cancel your subscription. In no event shall the Company's total liability to you for all claims arising from or related to the Service exceed the total amount you have paid to the Company in the twelve (12) months preceding the claim.

6.3 Essential Element

You acknowledge that the limitations of liability contained herein are an essential element of the agreement between you and the Company and that the Company would not provide the Service without these limitations in place.

The Service is provided for entertainment and informational purposes only. The content, features, and tools provided by Milestone are not intended to be, and should not be construed as, professional advice of any kind, including but not limited to medical, legal, financial, psychological, business, or life coaching advice.

While the Service is designed to assist with goal tracking and progress monitoring, it does not replace the guidance of qualified professionals. The Company strongly recommends that you consult with appropriate professionals before making any significant decisions related to your health, finances, career, relationships, mental health, or any other important life matters.

The Service is not designed to diagnose, treat, cure, or prevent any disease or medical condition. If you are experiencing a mental health crisis, suicidal thoughts, or any medical emergency, please seek immediate help from a qualified healthcare professional or contact emergency services.

All information provided through the Service, including suggested goal-setting strategies, progress tracking methodologies, and motivational content, are general in nature and may not be suitable for your individual circumstances. Results and effectiveness vary widely from person to person. The Company makes no representations about the effectiveness, reliability, or appropriateness of any content or recommendations for your specific situation.

Your use of the Service and reliance on any content or features within the Service is entirely at your own risk. The Company expressly disclaims all responsibility and liability for any outcomes, results, or consequences arising from your use of the Service or your reliance on any information provided therein.

You agree that you will not hold the Company, its officers, directors, employees, agents, or representatives liable for any harm, damage, loss, or negative outcome that may result from your use of the Service or your reliance on any content or features within the Service.
